Elvenstar Orange County General Release

The undersigned is an owner, rider, shower, viewer, sponsor, user, participant, guest, and/or is otherwise connected with the horses or horsemanship at Elvenstar located at the Huntington Central Park Equestrian Center (HCPEC). In consideration of the right to participate in such activity, view or otherwise be present at the Elvenstar facility located at the HCPEC, the undersigned:

1. Agrees to release and forever discharge JUH Inc, dba Elvenstar Orange County, Pineridge Ventures Inc, J Lazy 6 Ranch Inc, Elvenstar Ranch Trust, James Hagman, Jeffrey Hazeltine, together with their respective agents, representatives, employees, independent contractors, volunteers, officers, directors, stockholders, predecessors, successors, assigns, heirs, personal representatives and executors, and all persons, firms, associations, co-partners, co-venturers, subsidiaries, affiliates or corporations connected therewith, and each of the, from any and all claims, debts, liabilities, demands, obligations, costs, expenses, attorney's fees, actions whether known or unknown, including but not limited to those directly or indirectly related to the ownership, riding, showing, viewing, usage, sponsorship or grooming of horses on Elvenstar Orange County or any other matter related, either directly, or indirectly, thereto. Agrees to forever refrain and forebear from commencing, instituting or participating, either as a named party, in any lawsuit, action or other proceeding against those persons identified in paragraph 1 above, whether brought by themselves or by others on their behalf, based on or arising out of any and all matters set forth in paragraph 1 above*

2. Agrees to forever waive any and all rights that he or she may have under Sections 154-2 of the Civil Code of the State of California, which reads as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."*

3. Acknowledges that they have read, understand and agree to follow both the student rules and stable rules that have been established for their own safety, which rules are available in the business office, and which rules may be amended from time to time without notice.*

NOTE: Parents/guardians are not under any circumstances to leave minors under 18 years of age unattended at Elvenstar Orange County outside the continuous direct supervision of an adult family member, guardian or instructor; except that minors between the ages of 12 and 18 who own or lease a horse stabled at Elvenstar Orange County may be on site for up to three consecutive hours if and only if their parents have signed this General Release indicating their permission and express understanding that Elvenstar Orange County and its staff will not assume any supervisor/guardian type responsibilities for the minor. Violation of this rule without the express written consent of Elvenstar Orange County will result in the denial of access by the minor to Elvenstar Orange County. In addition to those matters set forth in the General Release, Elvenstar Orange County will not be responsible for the health, safety or welfare of any minor who is dropped off at Elvenstar Orange County and is denied access to the facility due to violation of this requirement.
